What sounds absurd , it's very common in the "lawyers land" !

Jim has found yesterday (see in details http://www.law.cornell.edu/topics/products_liability.html )

some very weird law interpretations - not only for safety of EEG device, but only for using it !
   
Ilustrating : if someone does any crazy thing (like jump from 32th floor's window and have
a openEEG over his table , that's might be lawsuit, for sure ! ( the eeg may have modified
the brain or behaviour of our said "hero" :-) - just joking, but untilauthor's already were suited because your readers did bad things which were supposed due to effects of his book )

FDA certificate would release of many troubles (including for find manufacturer) , but not all -

Therefore Yaniv suggests for we do not worry about fabricate ourselvesthe device , only project it
show and test it for the world .

The manufacturer would be responsible for the legal part ( he will "transmit" the costs for the user )
   
To stop the paranoia : (ascendent order of difficulty)
1) getting a lawyer -> 2) if possible, getting FDA certificate ->
3) find a manufacturer , honest,that assumes liability
issues and that charges very cheap for the EEG

Rob is right. I can't think of any such lawsuits either. Also,
precisely who is going to be sued here? I'm no lawyer, but I think
all we would have to do is form a non-profit corporation and total
liability would be limited to the (virtually nonexistent) assets of
the corporation.

On the topic of making money, BTW, I could see the group charging a
few bucks beyond the cost of the materials to reimburse the designers
for some of their time. Also this $$ could be used for incorporation
costs or whatever. Even the employees of non-profit corps can get
paid a little. Just a thought.
