So the datasheet was wrong in respect to the protection circuit.
In the LT1167f datasheet on page is written:
"...

Obviously with good reason...
This has not been the first error in datsheets I have encountered
and it will not be the last. So it is always a good idea to
countercheck information if something seems to be obscure...
